You Were Warned (#926)

Australian politicians are just as invested in demolishing the internet as US ones:

…The Court of Appeal for New South Wales has just dismissed an attempt by several Australian media outlets to overturn a 2019 ruling that they could be held liable for Facebook comments about [the state torture of a young man named] Dylan Voller…Voller…sued some of the media outlets that covered him—not because the news reports defamed him, but because other people writing on the outlets’ Facebook pages were accusing him of having committed various crimes.  Australian courts have not yet ruled on whether these comments defamed Voller.  This fight is about whether media outlets could even be sued for Facebook comments.  The outlets argue that…Facebook does not let them preemptively stop individual readers from posting comments on their page.  They do have the option to delete, hide, or report individual comments, but only after they’ve been posted…But the fact that these outlets have the ability to delete comments after the fact was enough for Judge John Basten to declare them publishers…Another judge suggested that a potential solution would be…censor[ing] content…If this ruling stands, it’s going to force Australian media outlets to monitor all comments and beef up their social media teams at a time when they’re having to lay off staff and even shut down newspapers

It’s so convenient to outsource tyranny to computers:

…certain combinations of Chinese characters have been immediately removed from [YouTube] within a few short seconds…[without] warning or reason…The Hanzi Which Shall Not Be Named were merely 共匪  (“communist bandit”) and 五毛 (“fifty cents”)…the term 共匪…was used by Nationalist partisans led by…Chiang Kai-shek against…Mao Zedong and the reds.  Today, it is considered a slur against the CCP…五毛 is a cleverer anti-CCP troll.  It’s basically calling a pro-CCP commenter a paid shill, albeit a cheap one.  The joke is that human CCP NPCs get paid fifty cents for each pro-CCP post; ergo, the “fifty-cent army” or 五毛党…those terms would not disappear from YouTube comments if you typed them out in English or in Pinyin…only…in the original Hanzi…YouTube is already banned in China and can be a pain to access without a good VPN and strong desire to do so…We are asked to believe that YouTube’s pesky algorithm just happened to accidentally disappear these very particular Chinese anti-government phrases since at least October of 2019…Perhaps the fifty-cent army flagged these phrases enough to become automatic triggers that the algorithm would automatically pull.  But it is also possible that someone at YouTube manually added these terms to a blocklist…Pressure from politicians of both parties contributed to Google winding down its proposed “Dragonfly” Chinese search engine that would have been compliant with CCP censorship demands…

In Hollywood movies, robots are characters; they are often funny, charming, resourceful or even heroic.  So naturally, in the movie Robocop, the title character was heroic, resourceful, and, to a degree, even funny and charming.  Of course, in real life, robots have no personality; they are (as Isaac Asimov once observed) “high-speed morons” which will do anything they are instructed to do, no matter how stupid, destructive or violent, without the slightest delay due to judgment, instinct, empathy, ethical considerations, or other human factors.  From the standpoint of rulers, then, real “robocops” would be ideal; they would inflict whatever violence they were instructed to inflict, using whatever criteria they were programmed to use, without an iota of conscience or personal ethics.  They would “only follow orders” and faithfully “do their jobs” by carrying out the whims of the rulers, no matter how idiotic, abominable or mutually-contradictory, without a moment’s hesitation.  So perhaps it’s a matter of judicial wishful thinking that in this century, US courts have increasingly ruled that cops are so robotically stupid that they are absolutely devoid of human moral judgment, and therefore cannot be held responsible for even the most flagrant violations of law, ethics or even basic common decency unless they are specifically instructed that the exact act, described in the most precise detail, is wrongful:

Two businessmen who [were robbed by] Fresno police [of] more than $225,000…are urging the U.S. Supreme Court to close a legal loophole that shields [cops] from liability.  Under “qualified immunity” victims can only sue government officials for damages if they prove that their rights were violated and that those rights were “clearly established.”  So when the two men, Micah Jessop and Brittan Ashjian, filed a civil rights lawsuit against the [robbers], their case was dismissed.  “There was no clearly established law holding that officers violate the Fourth or Fourteenth Amendment when they steal property seized pursuant to a warrant,” the Ninth Circuit Court of Appeals unanimously ruled in September…Ashjian told the Fresno Bee last year…“if the police have a search warrant that’s valid, they could steal your things and you don’t have the ability to pursue it…I am about as pro cop as anybody, but what happened doesn’t make any sense”…
It’s really too bad that we can’t, through some super-scientific reprogramming of the brains of these supposed “heroes”, force them to limit their depradations to judges, politicians, and other “pro cop” douchebags.  Alas, some things exist only in science fiction.

A rare case of “authorities” actually charging a serial rapist of sex workers:

Why I keep telling you local laws banning surveillance technology are feel-good bullshit:

California’s largest police departments have been collecting millions of images of drivers’ license plates and sharing them with entities around the country…in violation of state law…230 police and sheriff’s departments in the state currently use automated license plate readers…and…most of the data collected is on innocent people…The Los Angeles Police Department, for example, has collected more than 320 million images over the last several years.  Only 400,000 of those generated…matches to cars of interest, but the remaining 99.9 percent of the images, which can be used to track peoples’ movement across the city, stay stored in a department database for more than five years…The LAPD then adds other sensitive information to that database, sometimes tagging the photos with criminal records, names, addresses, and dates of birth

Headed toward the end of the hysteria, albeit 3 or 4 years late:

This is the sort of essay I originally envisioned we’d be seeing in 2016-17; unfortunately it took much longer because governments have been pushing it much harder than I anticipated to achieve their goals of internet censorship and migration control.  But prophecy is not an exact science, so I’m glad I wasn’t further off the mark.

Sometimes “trafficking” just means “bringing in brown people”:

Ten women filed a civil class-action lawsuit…accusing one of Canada’s wealthiest businessmen…Peter Nygard, of raping them at his…mansion in the Bahamas and operating…a “sex trafficking ring”…Three of the women were 14 years old at the time of the alleged rapes.  Three others were 15.  The alleged rapes took place between 2008 and 2015…There are no criminal charges associated with any of the allegations…The lawsuit goes on to accuse Nygard of drugging women…[bribing] Baham[ian cops and politicians]…and…paying police to threaten to arrest them…[Nygard’s lawyer] said the lawsuit is the latest in a decade-long attempt to destroy his reputation by his former neighbour in the Bahamas, U.S. billionaire and former hedge fund owner Louis Bacon…[which] began as a noise complaint and has evolved into multiple lawsuits in multiple countries…

Even if the lawyer is telling the truth, Nygard foolishly opened himself up to it by skeevy behavior.

A federal judge struck a major blow…to a Michigan sex-offender registration law, declaring large portions of the law unconstitutional and that the law cannot apply at all to offenders whose last offense was before 2011…The lawsuit was brought in 2016 by a group of John Doe sex offenders, all of whose offenses occurred before the act underwent amendments in 2006 and 2011.  The first of those made it illegal for offenders to live, work or loiter within 1,000 feet of a school, and the second required them to immediately report any new email or instant message accounts, phone numbers and vehicle license plates to police.  Those provisions, U.S. District Judge Robert Cleland…ruled, are too vague.  The reporting rules…are also unconstitutional…[and] since the amendments are not severable from the law itself…pre-2011 offenders are free from the law and its registration requirements in their entirety…
