Parable Kesha

Noah Berlatsky with another analogy for the absurdity of prohibition:

Should young women be allowed to enter the music industry?  That seems like a preposterous question.  But consider:  Kesha…filed a lawsuit against her former producer Dr. Luke…alleging that he had sexually, physically, and mentally abused her for a decade…Kesha’s lawsuit also alleges that Sony music refused to take steps to stop the abuse, and even covered up for it…The situation is not rare; producers and managers like Phil Spector and Ike Turner have physically and mentally abused their artists for years…Shouldn’t there be laws in place to prevent women from entering an industry such as this where they can be abused and harmed?  It should be clear why this is a bad idea.  Heavy-handed restrictions on women would hurt women, not protect them.  To make it illegal for women to be musicians and pop stars would be abusive and unfair in itself…And yet, when it comes to sex work, restricting women’s options in the name of “protecting” them is suddenly seen as reasonable, logical, and necessary…

How many more kids’ lives have to be destroyed before we stop the cops?

Police in a Pennsylvania school district have charged at least three kids—one of them just 11 years old—with distributing sexually explicit pictures of other minors.  They…face juvenile detention, expulsion, and a variety of other life-altering consequences.  This is somehow in their best interests—and the interests of kids everywhere—authorities claim…The levelling of charges…should not be viewed as some low-cost precondition to keeping kids safe, but a horrible, life-derailing consequence in and of itself…But we live in a country where paranoid delusions about safety provide cover for police to enforce absurd laws that make life miserable for kids…

Surplus Women 

Kenyan police are investigating the murders of 10 women working as prostitutes, a record number of attacks in one month that has led to fears of a serial killer…campaigners have called on the government to legalise prostitution and offer proper protection to vulnerable women.  The police commander in the town of Nakuru, where four bodies were found, said an intense manhunt was under way…Hassan Barua said security had been improved in the area, but would not comment on whether one suspect was wanted for multiple murders…

The Mother Learns From Her Children

Sex worker rights activists from around the world will join researchers and experts to present evidence to parliament in support of the decriminalisation of sex work.  The day-long symposium, organised by the English Collective of Prostitutes and hosted by shadow chancellor John McDonnell, is an opportunity for parliamentarians and the public to sidestep the charged emotion of international debates on the nature of sex work and hear crime-related, humanitarian, and public health analyses from leading academics and campaigners…The symposium will compare the outcomes of Sweden’s criminalisation of the buying of sex with the full decriminalisation model that has flourished in New Zealand…activists from Thailand, Taiwan, Canada and South Africa will explain how criminalisation, rescue and rehabilitation programs have affected sex workers there.  Rachel West, an American sex worker rights activist, will explore how a recent surge in anti-trafficking policing has disproportionately affected black sex workers and their clients…

The Lion and the Ox

Laura Agustín on the uselessness of the term “human trafficking”:

…There are young people now who have grown up surrounded by campaigning against trafficking, unaware there is conflict about how to define the term.  Some want to dedicate energy to combating what is figured as a modern social evil.  Some compare themselves with 19th-century anti-slavery advocates and feel outraged that anyone would question what they are doing…after…the idea of trafficking began its ascent…we who were interested in migration, sex work and labour policy realised it was useless for gaining equity or rights…the assumption is this human mobility to work is fomented by criminals who use force and coercion against their victims…Behind this over-simplification and over-focus on sex lie real social inequalities and oppressions:  migration policies that favour middle- and upper-class jobs, out-of-date notions of the formal economy and productive labour, young people who want to get away from home, job-seekers willing to take risks to make more money, laws that make commercial sex illegal, laws that make sweatshops illegal and…more.  To lump all this under a single term simply disappears the array of different situations, encourages reductionism and feeds into a moralistic agenda of Good and Evil…

King of the Hill (#421)

“The Harvard of sex trafficking” has now morphed into “The Harvard of pimp school”.  Or was it really the other way around?  Does it really matter, when both phrases are utterly ludicrous?

Milwaukee has become “the Harvard of pimp school” and Wisconsin is a hub of human trafficking, a [self-declared] expert has said in the wake of an FBI sting last month in which nine adolescents were [arrested]…meaning Milwaukee is tied with Las Vegas for the third highest number of young people [arrested]…Denver topped the list, with 20…and Detroit was next with 19.  Over the past four years, however, Milwaukee has consistently ranked among the top five cities in the nation for [arrests of underage sex workers]…

A…Houston mother of two says she was raped in her hospital bed by a doctor…she reported the rape to nurses who responded with cold skepticism.  She had to wait nearly two years for police to collect the alleged attacker’s DNA and make an arrest.  And now…Dr. Shafeeq Sheikh…may get off scot-free in civil court.  And Texas law may entitle her to only modest compensation from Sheikh’s employer at the time of the rape, the prestigious Baylor College of Medicine…Baylor doctors staff Ben Taub, which is a public hospital owned by Harris County.  The doctor isn’t the only one who can deploy the “government unit” shield.  Baylor lawyers have successfully argued that the college itself can be construed as a government entity and is entitled to the same protections a county institution would enjoy…Baylor can argue it is immune to the claim altogether…and…the Texas Supreme Court has ruled that rape in some circumstances is covered by medical malpractice laws…Gillian Anderson looking stupid again

Oakland City Council Takes Stand Against Sex Workers“.  Seriously.

On October 20…[Oakland, California] endorsed…The “CEASE Network”…a project of Demand Abolition, a Boston-based program dedicated to “eradicating the illegal commercial sex industry” by going after “demand.”  That means targeting clients…Demand Abolition is a program of Hunt Alternatives, the foundation of Swanee Hunt…the daughter of…oil tycoon H.L. Hunt…The groups fund law enforcement and public media campaigns and advocate for stronger legal penalties…when police agencies and district attorneys broadly target demand, they end up wasting resources on arrests and prosecutions that further criminalize adult sex workers and their clients…the Demand Abolition approach…[threatens] marginalized workers in the sex industry.  That was a concern of government officials in San Francisco, which last year ended a brief partnership with Demand Abolition after facing a backlash from…sex workers…

Finding What Isn’t There

At least US “authorities” don’t yet lock up people who debunk “sex trafficking”:  “Police in [The Gambia]…detained Sanna Camara, a journalist…as a result of a story…[in which police officials] admitted that [they] face challenges in combatting human trafficking…due to the unwillingness of victims or their families to aid investigations…”  In other words, those identified as “victims” refuse to play their assigned roles.

Wise Investment (TW3 #335)

The Chief Justice of the British Columbia Supreme Court, Allan McEachern, ruled on July 4, 1984, that sex workers on the Davie Street stroll were a “blatant, aggressive, and disorderly public nuisance”…and…banned [them] from their neighbourhood…[they] were forced to relocate…to what became the killing fields of…Downtown Eastside, with 65 women murdered since the mid-1980s…we seek a formal, public apology from Vancouver…[and] financial reparations…for a permanent memorial near the corner of Bute and Davie streets…

Innocence Never Had

Emi Koyama on how the “trafficking” paradigm harms young sex workers:

Meanwhile Margaret Corvid, the dominatrix whose writing I criticized in the original of this title, apologized for her original wording and wrote this article to demonstrate her real feelings on the subject:

Marching Up Their Own Arses (TW3 #414)

If your local cops claim that “prostitution is…one of the biggest problems they face,” I suggest it’s time to stop wasting money on a police department.  The most hilarious part of this article: the idea that there is such a thing as a “legal escort service” that can be “differentiated from illegal prostitution”.  Blah blah blah “not a victimless crime”, blah blah children, blah dirty whores, blah disease, blah licenses, booga booga SEX TRAFFICKING!

The Mote and the Beam (TW3 #419)

Elizabeth Brown analyzes the danger of the latest “sex trafficking” Trojan horse:

The “Stop Advertising Victims of Exploitation (SAVE) Act“…would…require all sites that host adult advertising (whether paid or free)…to review ads before publication, request a valid telephone number and credit card number from each poster, “prohibit the use of euphemism and codewords”…and prohibit the use of prepaid debit cards or cryptocurrencies in placing paid ads.  For sites that run paid adult advertisements, publishers would be responsible for verifying the identity of every person who placed an adult ad by obtaining a copy of a government-issued ID containing their name, photo, and date of birth.  The publisher would have to hold on to these records for seven years and make them…available to the [“authorities” on demand]…The bill insists that information won’t be used against registrants in criminal proceedings unrelated to sex trafficking.  But knowing how fond government and law enforcement officials are of privacy and keeping promises, you can see why those advertising adult services…may be reluctant to hand over such information…

The most important real-world effect of this law would be to drive virtually 100% of adult advertising to sites hosted outside of the US.

The June 25 seizure of…MyRedBook…by the FBI has been heralded by some as another win in the war against…child sex traffickers…the FBI and CNN…fail to mention that the site also functioned as a critical exchange for sex workers looking to reduce harm and share best practices…the seizure has not only cut off a source of income for sex workers, but also a source of information and community…among crusaders committed to criminalizing sex workers and the people who purchase their services…sex workers…are either trafficked girls shackled to beds when they’re not servicing sadistic ghouls, or they are thrill-seeking degenerates blissfully unaware of their privilege…The former daydreams of a police raid that will liberate her…while the latter feverishly supports the “Pimp Lobby” from Twitter…The massive gulf of silence between these two caricatures gives space to a convenient narrative that…the overwhelming majority of sex workers require intervention by benevolent law enforcement agencies…

Lucy Steigerwald points out that there are scary implications for amateurs, too:

Bone of Contention

This is a good article about the myths surrounding streetwalkers, including 1) That they make huge amounts of money; 2) That they’re all addicts; 3) That they’re all foreign and “trafficked”; 4) That they’re dominated by pimps and gangs; 5) That they need rescue; and 6) That arrest and prison “help” them.  Unfortunately, it’s far too accepting of the false claims made by Swedish model proponents, which in the end makes it hard to recommend.

Last Saturday, Kristof the Rat turned on his “hero” and downplayed his pivotal role in enabling her depredations on Cambodian sex workers:  “I wrote one column about her life story in 2008 after her autobiography was published in the U.S., and made several references to her after that, most recently in 2011…”  Kristof’s numerous columns on Mam, his “live tweeting” of one of her brothel pogroms, his spending a large fraction of his Half the Sky catechism on her…all would be flushed down the memory hole if he had his way, though the readers aren’t having it (see the comments) and neither is at least one editor of Kristof’s own newspaper.  Kristof wants to pretend that he was no more gullible than others, that everyone shares his credulity and his perverse need to impose his Gorean BDSM fantasies onto the lives of real women; he states “we were all hoodwinked” despite the fact that Cambodian sex worker activists have been documenting Mam’s lies and abominations for years.  He also wants people to keep believing in the “sex trafficking” mythology he’s been so instrumental in building, but that’s starting to unravel, too:

…willing sex workers who had been rounded up off the street during a police raid and…confined…for months as purported victims…[were] instructed by [Somaly Mam] to tell foreign visitors they had been trafficked…Although [her personal] stories…have now been widely scrutinised in the media, less examined have been Mam’s frequent embellished statements about the scale and nature of sex trafficking in Cambodia.  The term “trafficking” has become trendy…in the Western world…but it leaves out a whole spectrum of complex choices and negotiations, and often erases women’s agency entirely…

This collection of single sentences  about the “sex trafficking problem” in Boise, Idaho (population 200,000; known chiefly for lumber and potatoes) is not actually organized into a coherent article; apparently, its “writer” is a dual devotee of the “sex trafficking” cult and the Hemingway software.  The gems found therein include (multiple sic):  “a child is taken in…they’re used not only for prostitution but also in gang organized crimes”; “victims…go through a ‘moral development’ period…in order to stay safe they must go along with their captures”; and “investigators…believe that a major problem stems from the Internet…‘where kids play online’”.

Bottleneck (TW3 #324)

This breathless article from the Canberra Times is clearly intended as an attack on decriminalization in New South Wales:  it spouts “sex trafficking” nonsense; quotes cops, politicians and an NGO named “Brothel Busters”; and does not quote any sex worker organizations at all.  But like many prohibitionist screeds about the “failure” of legal sex work regimes, it ignores a vital point:  the women it discusses are only victims because they are specifically excluded from working legally via some legal bottleneck, in this case the inability to get visas for sex work.  Naturally, Scarlet Alliance has repeatedly warned the government about this exact issue.

Bootlickers (TW3 #326) 

Because surely there are scads of women who think escort to barista is a good career move:

[Sheriff’s Sgt. Darrell L. O’Neill] was charged…with felony promoting prostitution…for allegedly tipping off bikini baristas in exchange for sexual favors…[cops claim] Java Juggs stands hire young women who have worked as strippers and escorts and “essentially operate as drive-through strip clubs or brothels”…

Innocence Never Had

Another useless public policy based upon the absurd notion of magical “pimp” mind control powers:

[Los Angeles] officials are exploring a plan to require more…training for foster parents and group home workers to help them recognize …signs that children and teens under their care may be victims of sex trafficking…pimps sometimes recruit underage sex workers from group homes…Rachel Thomas, a sex trafficking survivor [said]…”There’s a grooming process…with recognizable signs.”

The Punitive Mindset (TW3 #352) 

Campaigners fighting the Ministry of Justice over a ban on books being sent to prisoners…threatened to take their battle to the courts…Geoffrey Robertson QC, who has offered his services for free, said…justice secretary Chris Grayling [is] acting “unlawfully and irrationally”…to inflict “cruel and unusual punishment” on literate prisoners.  “Grayling is not a lawyer, he is a politician who seems to think he is above the law,” said Robertson…”He has no power to impose additional punishment on prisoners over and above that which is imposed by the courts.  The action has nothing to do with prison security or any other legitimate purpose”…Grayling [pretends]…”the arrival of thousands of unknown parcels in our prisons each day”…would undermine the…battle against drugs…

Something Rotten in Sweden

Meet the new and improved version of the Mann Act:

U.S. lawmakers have introduced a bill to strengthen federal laws against child sex trafficking…Members of Congress say arresting and prosecuting pimps is not enough, that those who pay to have sex with children must also face federal penalties…The End Sex Trafficking Act of 2013 mandates that those who seek sex with children will be prosecuted under federal law, which comes into play when there is trafficking activity across more than one state…

If the final language really is this vague – “those who seek sex with children will be prosecuted under federal law” – this Act will essentially overturn all state age of consent laws because federal law defines anyone below 18 as a “child”.

Dear Family Research Council:  More sex ≠ better sex; “feeling loved” during intercourse ≠ better sex; buying sexy underwear ≠ better sex; not knowing what good sex is ≠ better sex…see the pattern yet?

Devout, married Catholics have the best sex of any demographic group, the Family Research Council said…pointing to…statistics from the University of Chicago’s last National Health and Social Life Survey, conducted in 1992, which found the most enjoyable and most frequent sex occurring among married people, those who attended church weekly – any church, whether Catholic or not – and people who had the least sexual partners…[FRC fellow Patrick] Fagan said it was clear “those who are monogamous have the best sex they ever could – because its [sic] the only sex they’ll ever know”…68 percent of Catholics professed to have sex at least once a week versus 56 percent of non-Catholics; 30 percent of Catholics had bought erotic underwear versus 20 percent non-Catholics; and 80 percent of devout Catholic women approved of having sex for pleasure alone…the Family Research Council…also cautioned…of the possible negative effects of enjoying sex outside of marriage, or of watching porn…

Florida officials support a campaign to give them more power; what a surprise!  “Adding just two words to one of the nation’s first online laws might step up the war against prostitutes, pimps and child sex traffickers…police and prosecutors in nearly every state…are calling on Congress to amend the Communications Decency Act of 1996 so state laws can be used to bring charges against websites such as Backpage…”  Ken White explains why this would be a spectacularly bad idea:

A woman…coerced into oral sex by [a] Beaverton [Oregon] police officer in 2010 accepted a settlement in her lawsuit…[Joshua] Jensen pleaded guilty to…official misconduct and coercion charges…[stemming] from two incidents…in which [he] arranged to meet a prostitute…and…[showed] up in uniform, in a marked police car.  Both women [said] he ordered them behind a garbage container.  The woman who sued him said he grabbed her head, forced it down and demanded that she perform oral sex…Jensen was not charged with a sex crime and did not have to register as a sex offender.  He was sentenced to two and a half years in prison…[but] completed his sentence in November 2011 through an Alternative Incarceration Program.

Other rapists get lifetime sentences on the “sex offender” registry; Jensen got a slap on the wrist.

The Slave-Whore Fantasy

A Chinese court sentenced [Li Hao, 35] to death for holding six women as sex slaves…and killing two of them…the former local government employee kidnapped six nightclub and karaoke bar workers and repeatedly raped them in a self-built dungeon.  Two of the six were found dead when a 23-year-old woman escaped and led police to the basement.  Li forced them all into prostitution and filmed them in pornographic videos he put on the internet…He then instructed three women to kill two of the other captives.  The three women were found guilty of murder but were given lenient sentences.  One was jailed for three years and two were put on probation…

It seems credulity and sloppy scholarship aren’t Sudhir Venkatesh’s only flaws:

It’s nice to know that at least one European government is so free from economic concerns that it has time to deal with the little things:

Harvey Silverglate reminds us that some of the victims of the Satanic Panic are still rotting away in prison for “crimes” that never happened:

…Elizabeth Ramirez, Kristie Mayhugh, Anna Vasquez and Cassandra Rivera…[were] accused in 1994 of repeatedly raping Ramirez’s two nieces, then 7 and 9 years old…Mayhugh, Vasquez and Rivera are twelve years into a 15-year sentence.  Ramirez was accused of being the ringleader, so she received 37½ years.  All four of the women refused pretrial plea deals…and three have refused parole offers conditioned on an admission of guilt and completion of a “rehabilitation” course for sex offenders…In September, one of the accusers recanted, saying she now seems to recall a quiet, even boring, weekend with her aunt, her sister and her aunt’s friends.  She has vowed to do everything in her power to help exonerate the four women still imprisoned as a result of her earlier false accusations…

As in other “Satanic Panic” cases and most “sex trafficking” cases, the total lack of concrete evidence, the fact that the accusers’ stories changed frequently and their history of false rape accusations (instigated by their sociopathic father) made absolutely no difference to prosecutors, jury or judge, who wanted to “send a message” that “alternative lifestyles” (the women are lesbians) would not be tolerated.

Coming Out

Melissa Petro is broke, and therefore thinking “a lot” about going back into hooking even though she has often said she didn’t like it.  That’s why her voice is valuable; as I said before, “I think it’s extremely important for women who don’t love the work to come out, because I honestly believe they’re the majority.  Everybody hears from the ‘happy hookers’ and the ‘survivors’, but…for most of the women I’ve known it was a job like any other, with its own advantages and disadvantages…

Prohibitionists are furious that the Israeli legislature allowed the wildly-unpopular (opposed by 59% of Israelis) Swedish model to die in committee, but what makes this prohibitionist op-ed entitled “Prostitution in Israel: Myth vs Reality” so interesting (if nauseating) is that it completely inverts the two, labeling myths as “facts” and vice-versa.  One wonders how people manage to make it through life in such a deeply-delusional state.

Despite a few good advance hints, the news about DSM-V is mostly bad:

Beside a two-part column on the myth that most whores are enslaved by pimps, this week also featured posts on Barbie, Saint Nicholas, toys, the Salvation Army, my favorite bands and albums, “sex addiction”, sugar daddy sites and the bizarre pretense that historical courtesans were not prostitutes.  We also saw articles on the anti-whore hostility of Canadian “authorities”, the lack of outrage when criminals use Craigslist to commit non-sex related crimes, and why ignorance really is bliss for some people, and I gave advice to a young man who wanted to “rescue” a hooker.
